Terms and Conditions

Please be aware Location Specific Terms and Conditions may apply to this Contract in the location in which you are normally resident. If so, they will be set out in Part 2 and any General Terms that conflict with the Special Terms and Conditions will not apply to the extent they are limited by the Special Terms and Conditions.

Definitions

Cancellation Period means the 14-day cancellation period described in clauses 11.5 to 11.7 of the General Terms and Conditions.

Content means any material from classes delivered online or other digital content or material that is made available (whether real-time content or self-access).

Contract means the legally binding contract between you and Communication Chain.

A fixed Plan means a particular type of plan that you choose to purchase. A fixed plan is defined as a one-off payment.

General Terms and Conditions means the terms set out in Part 1 of these Terms.

Location Specific Terms and Conditions mean the terms (if any) set out in Part 2 of these Terms, and which set out any additional local law variations to the General Terms and Conditions.

Order Confirmation means an order confirmation emailed to you by clause 2.2 of the General Terms and Conditions.

We, us, our refers to Communication Chain. You

u refer to the person agreeing to these Terms.

1) How the Contract is formed

1.1 Once the Payment system receives a legitimate payment for the Plan into its designated bank account, your Order Confirmation will be emailed to you. 

1.2 The Order Confirmation confirms Communication Chain’s acceptance of your order and the Contract will only be formed, and become legally binding when the Order Confirmation is provided to you. 

2) Your obligations when taking lessons

2.1 You are responsible for ensuring you have in place all hardware, software, and telecommunications necessary to access classes and will be responsible for all related charges, including the fees of internet service providers.

2.2 You agree not to:

(a) use our lessons in any way that prevents, disrupts, or interferes with any other person’s use of their lessons;

(b) abuse, harass, threaten, impersonate, or intimidate other students;

(c) upload or display any comments or materials through your participation that are false, offensive, sexually explicit, defamatory, threatening, obscene, or unlawful.

(d) to transmit information that contains a virus, worm, Trojan horse, or other harmful or disruptive components;

(e) change, modify, delete, interfere with, or misuse any files or other data created, owned, or provided by Communication Chain (except as expressly permitted under these Terms).

3. Products 

Lesson Cancellations & No Shows

3.1 If you cancel more than 48 hours before a scheduled individual or group lesson, you will maintain the right to reschedule the lesson.

3.2 If you cancel less than 48 hours before the class or fail to show up, you will lose the lesson.

4. Refunds & Cancellation.

4.1 Once you have purchased any of the available packages from Communication Chain, you will not be entitled to any refunds or additional lessons, even if lessons are cut short by technical difficulties or unclear sound quality. Any requests for refunds or additional lessons will be evaluated on a case-by-case basis at the sole discretion of Communication Chains’s management.

4.2 Communication Chain may cancel the Contract by giving you notice in writing (whether by email or otherwise) for any reason at any time before the Start Date. If Communication Chain cancels the contract pursuant to this clause, it will refund the price paid by you for the relevant product.

4.3 Communication Chain may also cancel the Contract at any time, without liability to you if:

(a) you breach these Terms (but not if it’s a trivial breach); or

(b) Communication Chain is unable to provide the relevant Product in full due to a reason beyond its reasonable control.

4.4 If your order is for digital content or services, the Cancellation Period will end 14 days after the day on which you receive your Order Confirmation.

4.5 To exercise the right to cancel, you must inform Communication Chain of your decision to cancel the Contract by a clear statement (e.g. a letter sent by post or an email – see the Contact Us Page for the relevant contact details). 

4.6 To meet the cancellation deadline, it is sufficient for you to send your cancellation statement before the Cancellation Period has ended.

4.7 If you have a right to cancel, and do cancel, the Contract within the 14-day Cancellation Period, Communication Chain will reimburse you all payments received from you in respect of the relevant Products subject to the following:

-Lessons scheduled/and or attended within the 14-day period.

4.8 Communication Chain will make the repayment without undue delay, and not later than 60 days after it is informed about your decision to cancel the Contract.

4.9 Communication Chain will make the repayment using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the repayment. 

*Please note that Communication Chain cannot make payments to banks sanctioned by Swift or any other relevant payment system. If you request a refund to be sent to an account at a sanctioned bank, you will be asked to nominate an alternative method of payment that does not breach sanctions.

5.1 After the Cancellation Period has expired, you have no automatic right to cancel the Contract. Any cancellation of the Contract after this period will need Communication Chain’s approval – please contact Communication Chain directly to explain why you would like to cancel the Contract and to see if Communication Chain will accept the cancellation. 

6. Teachers

6.1 Our teachers are contractors & we expect them to follow the strict application of our Privacy Policy (also attached to the website). However, we are not ultimately responsible for what they do with any information you volunteer to give them in the course of the lessons with them.

6.2 Teachers will be held directly liable should the tone or content of their communications with you be deemed offensive in any way. We hold no responsibility for this, although we will be sure to investigate and discipline the offender if necessary, including, but not limited to, suspending or terminating their contract with Communication Chain or reporting their conduct to the relevant government authorities.

7. Equipment and Conditions

7.1 The following equipment is strongly recommended for you to maximize your experience as a student at Communication Chain:

7.2 Communication Chain does not bear any responsibility for the quality of your Internet connection. Communication Chain’s video conferencing platform is powered by third-party infrastructure and will not be able to reimburse students on this basis. Please communicate directly with your Internet Service Provider if problems persist.

8. Teacher cancellation

8.1 We apologize for any instances of your teacher at Communication Chain being late for a scheduled class or missing it completely. In the event that your teacher misses a scheduled class or turns up late, please inform us immediately. You will not be charged for that lesson, and we will investigate the incident and assure you that the teacher will be appropriately sanctioned for their misdemeanour.

8.2 From time to time, some teachers will cancel booked lessons in advance. You will be immediately notified of the cancellation and will be allowed to re-book your lesson with another teacher of your choice. Your account will not be debited for the cancelled lesson, and we will credit you with an extra free lesson to help make up for any inconvenience caused.

8.3 If you are not present for your lesson by 15 minutes after its scheduled start time, the class will be deemed cancelled, and you will be charged in full.

9. Equality, Diversity and Inclusion

9.1 If you have a disability or special need, Communication Chain will make reasonable adjustments to make sure that you have, as far as is reasonable, the same access to everything that is involved in our teaching Service as a person without a disability or special need.

9.2 Please provide a Communication Chain with details of your disability and special needs as soon as possible upon starting your Plan.

10. Communication Chain’s liability to you

10.1 Communication Chain shall not under any circumstances whatsoever be liable to you (whether for breach of contract, negligence, breach of statutory duty, or otherwise) for any: loss of profit, loss of business, business interruption, or loss of business opportunity arising under or in connection with the Contract.

11. Failure to comply with these Terms

11.1 If Communication Chain believes that you have not complied with these Terms, Communication Chain may:

-Refuse your further use of and/or access to classes.

-Terminate the contract with immediate effect. 

12 Disintermediation

12.1 Communication Chain teachers and its client’s teachers are exclusively authorised to teach with Horizon. Should they solicit students to take private lessons apart from what is scheduled by Horizon, or should they attempt to contact students outside of lesson hours, we would appreciate it if students would immediately report them.
